Dumpster Permits in Hampton Roads: What to Know Before Delivery

Private property vs the public right-of-way

Most people asking do I need a permit for a dumpster are placing it on their own driveway, and that is the simple case. A dumpster on your own driveway or private lot normally doesn't need a permit.

It changes when the container has to sit on a public street, sidewalk, alley or the grass strip between the sidewalk and curb. That land is usually part of the public right-of-way, and the city may require right-of-way approval before anything is placed there. We do not quote permit rules or fees because they vary and change, so the safest move is to check with the city before delivery day, or call us at 757-250-7985 and we will talk through placement.

HOA and neighborhood rules

Homeowner associations are a separate layer from the city. Many HOA communities in places like Kings Grant, Greenbrier or Kiln Creek have their own guidelines on how long a container can sit, where it can go and whether you need to notify the board.

Read your covenants or email the management company before you book. Getting written approval in advance is far easier than answering a violation letter halfway through a remodel. Rental homes add one more step: tenants should clear placement with the landlord or property manager.

Questions to ask your city's public works or permits office

If street placement is your only option, a short call to the city's public works, transportation or permits office usually clears things up. Have your address and rental dates ready, then ask:

  • Is approval needed for a roll-off container on this street or sidewalk?
  • Which department handles it, and how far ahead should I apply?
  • Are there requirements for reflectors, cones or lighting at night?
  • Is there a limit on how long the container can stay?
  • Does the approval need to be posted or kept on site?

Placement checklist for delivery day

Whether or not a permit is involved, good placement saves time and avoids a $125 dry run fee if our driver cannot set the container. Driveway protection boards are included with every rental.

  • A clear, straight approach for the truck, plus room for a 22-foot container if you are ordering the 20 or 30 yard
  • Overhead clearance free of power lines, cable drops and low branches
  • Firm, level ground; soft lawn after rain is a poor choice
  • Cars, trailers and boats moved before delivery and pickup
  • Gates unlocked and the drop spot marked with a cone or note

City-by-city notes for our service area

Virginia Beach. Driveways in Kempsville, Great Neck and Red Mill handle most containers with no issue. Oceanfront and Sandbridge rentals often have tight lots, so street placement may require approval from the city; check with Virginia Beach before scheduling. More on our Virginia Beach dumpster rental page.

Norfolk. Older neighborhoods like Ghent, Park Place and Colonial Place have narrow streets and alley access. If your container cannot fit on private property, Norfolk may require right-of-way approval, so call the city ahead of time. See dumpster rental in Norfolk.

Chesapeake. Many Great Bridge and Grassfield homes have wide driveways that avoid the question entirely. For curbside placement in older areas like South Norfolk, check with Chesapeake about whether any approval may apply.

Newport News. Hilton Village and Hidenwood have smaller lots and mature trees to plan around. If the street is the only option, contact the city to confirm what Newport News may require.

Hampton. In Phoebus, Buckroe Beach and Fox Hill, waterfront lots and soft ground can limit driveway space. Ask Hampton's permits office whether street placement may need approval before you commit to that spot.

Portsmouth. Our home base. Olde Towne and Port Norfolk homes sit close together with on-street parking, so street placement is common and the city may require approval. We can walk through options on a call.

Suffolk. Long rural driveways in Driver, Chuckatuck and Holland usually offer plenty of private space. In denser Harbour View or downtown blocks, check with Suffolk before placing anything on the road.

York County. Most Tabb, Grafton and Seaford properties can keep a container on the driveway. For anything in the road, check with the county rather than assuming.

Isle of Wight County. Smithfield's historic district and growing Carrollton subdivisions may each have their own considerations. Confirm with the county and any HOA before delivery.

Choosing a size that fits your spot

A smaller container can sometimes keep you on private property and out of the permit question. The 10-yard dumpster is about 12 feet long and fits places a 22-foot box will not. Compare all three in our dumpster sizes guide, and check the dumpster rental cost breakdown to see how extra days factor in if approval takes time. If a container will not fit anywhere, junk removal skips placement entirely.

Questions We Hear Most

Do I need a permit for a dumpster in my driveway?

A dumpster on your own driveway or private lot normally doesn't need a permit. HOA rules may still apply, so check your covenants. If the container must sit on a public street or sidewalk, the city may require right-of-way approval, so check with the city first.

How do I find out if Virginia Beach or Norfolk requires a dumpster permit?

Contact the city's public works, transportation or permits office and describe where the container will sit and for how long. They can tell you whether approval is needed and how to apply. You can also call us at 757-250-7985 and we will help you think through placement options.

Will First Priority Disposal get the permit for me?

Requirements differ by city and location, so the property owner or renter usually handles any city approval. We are happy to help you figure out the best spot for the container, which often keeps it on private property and avoids the question altogether.

Can my HOA stop me from having a dumpster?

An HOA can set rules on placement, timing and notice, and some require advance approval. Read your community guidelines or ask the management company before booking. Getting approval in writing ahead of time is the best way to avoid problems mid-project.

Can a dumpster go on my lawn instead of the street?

Sometimes, if the ground is firm, level and accessible for our truck. Soft or wet lawns can rut, and septic fields or irrigation lines should be avoided. We include driveway protection boards, and we will talk through whether a yard placement makes sense for your property.

What if I cannot get approval in time for delivery?

Let us know and we can reschedule, since a blocked or inaccessible site can trigger a $125 dry run fee. You might also consider a smaller container that fits on private property, or junk removal, where our crew hauls everything away without a container staying on site.
