Agreement & AcceptanceYour Agreement With First Priority Disposal
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and First Priority Disposal, LLC ("First Priority Disposal," "FPD," "we," "us," or "our"), a Virginia-based, veteran-owned business operating in Hampton Roads, Virginia.
By booking, scheduling, or using any service offered by First Priority Disposal — including but not limited to roll-off dumpster rentals, junk removal, and commercial waste hauling — you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, please do not book or use our services. If you have questions before booking, we encourage you to contact us at 757-250-7985 or dispatch@firstprioritydisposal.com.

Booking & SchedulingHow Reservations Work
Bookings may be placed by phone, text message, email, or through our online request form. A reservation is confirmed only when First Priority Disposal provides written or verbal confirmation, including a scheduled delivery date and time window.
We make every effort to offer same-day and next-day delivery when availability allows, which is significantly faster than the industry-standard 24–48 hour lead time. However, delivery windows are estimates and not guarantees. Factors outside our control — including traffic, weather, mechanical issues, or prior job overruns — may affect timing. We will communicate proactively via automated text and phone notifications when your driver is en route.
Saturday deliveries and pickups are available at no additional charge. Sunday service is subject to availability; contact us at 757-250-7985 to confirm.
Pricing & PaymentsFees, Billing & Overages
First Priority Disposal is committed to 100% transparent pricing. You will be informed of all applicable fees before your booking is confirmed. The following additional fees may apply beyond the base rental price:
| Fee Type | Amount | When Applied |
|---|---|---|
| Weight Overage | $110.00 / ton | Billed prorated for weight exceeding the included tonnage |
| Extended Rental | $25.00 / day | Applied after the 7-day rental period |
| Dry Run Fee | $125.00 | Container blocked, overloaded, or inaccessible at scheduled pickup |
| Fuel Surcharge | $35.00 | Flat fee applied to every rental |
| Mattress / Box Spring | $100.00 each | Landfill surcharge per item |
| Tires | $75.00 each | Landfill surcharge per standard passenger tire |
| Overweight Penalty | $250.00 / ton | Applied ONLY if the container exceeds the legal 10-ton maximum road weight limit |
Payment is due at time of booking or delivery unless other arrangements have been made in writing. We accept major credit cards, debit cards, and approved electronic payment methods. Commercial accounts with approved Net-30 terms are governed by the separate commercial account agreement (see Section 14).
Rental Period & ExtensionsHow Long You Can Keep the Container
Every dumpster rental includes a standard 7-day rental period beginning on the date of delivery. The container must be accessible for pickup at any time during this period and upon scheduling by you or us.
If you require additional time, rental extensions are available at $25.00 per day. To request an extension, contact us before the 7-day period expires at 757-250-7985 or dispatch@firstprioritydisposal.com. Containers not extended and not made accessible for pickup may be subject to the Dry Run Fee.
First Priority Disposal reserves the right to retrieve the container after the rental period expires if no extension has been arranged, with reasonable advance notice to the customer.
Delivery & PlacementWhere and How We Drop Off
The Customer is responsible for selecting a safe, accessible, and legally permissible location for container placement. First Priority Disposal will make reasonable efforts to place the container where directed, but reserves the right to decline placement in locations that present safety risks, potential property damage, or legal concerns.
We use heavy-duty protective boards placed under every container at no additional charge. This is a standard practice on every delivery — not an upsell. While driveway boards significantly reduce the risk of surface damage, FPD is not liable for pre-existing surface cracks, damage to driveways with structural weaknesses, or damage resulting from customer-directed placement.
If a container must be placed on a public street, alley, or right-of-way, the Customer is solely responsible for obtaining any required municipal permits. First Priority Disposal does not obtain or apply for street permits on behalf of customers. If placement on a public right-of-way requires a permit and one is not obtained, the Customer assumes all liability for fines, violations, or container removal by municipal authorities.
Prohibited ItemsWhat Cannot Go in the Container
Due to federal, state, and local environmental and safety regulations, the following items are strictly prohibited from being placed in any First Priority Disposal container. Violation of this policy may result in additional fees, refusal of pickup, or reporting to appropriate authorities:
- Hazardous waste, chemicals, or toxic liquids of any kind
- Wet or liquid paint (dried paint cans in sealed containers are acceptable)
- Batteries of any type (automotive, household, lithium, etc.)
- Asbestos-containing materials
- Refrigerators, air conditioners, or any appliance containing Freon, unless properly tagged as professionally evacuated by a certified technician
- Medical or biohazardous waste
- Flammable liquids, propane tanks, or compressed gas cylinders
- Electronics with hazardous components (e-waste), unless arranged separately
- Any item banned from landfill disposal under Virginia state law
If you're unsure whether an item can go in the container, call us at 757-250-7985 before loading. We'd rather answer a question than deal with a compliance issue.
Weight Limits & OveragesUnderstanding Tonnage and Road Limits
Each container rental includes an allowance for a specified weight of material. Exceeding the included tonnage results in overage charges billed at $110.00 per ton, prorated based on certified scale receipts.
Virginia state law imposes a maximum road weight for loaded vehicles. If a container exceeds the legal 10-ton road weight threshold, an Overweight Penalty of $250.00 per ton is applied. This is not a standard overage fee — it is a compliance fee required to cover the legal liability and regulatory costs associated with transporting overweight loads on public roads.
Customer ResponsibilitiesYour Obligations During the Rental
By booking a service with First Priority Disposal, you agree to the following responsibilities throughout the duration of your rental:
- Access: Ensure the container is accessible for delivery and pickup. Blocked access will trigger the $125.00 Dry Run Fee.
- Prohibited Items: Do not place any items listed in Section 7 in the container.
- Fill Level: Do not load material above the top rim of the container. Overloaded containers cannot be safely transported and will not be picked up until excess material is removed.
- Permit Compliance: Obtain any required municipal permits for street placement (see Section 6).
- Accurate Information: Provide accurate placement address, contact information, and project description at time of booking.
- Property Conditions: Disclose any known surface defects, low-clearance issues, or other conditions that could affect safe delivery or pickup.
- Supervision: You are responsible for monitoring what goes into the container and ensuring that neighbors, contractors, or other third parties do not use the container without your authorization.
Cancellation & RefundsHow Cancellations Are Handled
We understand that project timelines change. Our cancellation policy is designed to be fair to both parties:
- Cancellation before delivery: Cancellations made more than 24 hours before the scheduled delivery window will receive a full refund of any deposit paid.
- Cancellation within 24 hours of delivery: Cancellations made within 24 hours of the scheduled delivery window may be subject to a cancellation fee not to exceed $75.00, or the deposit may be applied toward a rescheduled delivery at your option.
- Same-day cancellation after dispatch: If a driver has been dispatched and the delivery is cancelled or cannot be completed due to customer-side issues, the $125.00 Dry Run Fee applies.
- After delivery: Once a container has been placed on your property, no refund is available for the base rental fee. Early pickup does not result in a prorated refund.
To cancel or reschedule, contact us at 757-250-7985 or dispatch@firstprioritydisposal.com as early as possible. We'll always do our best to work with you.
Liability & IndemnificationLimits of Our Responsibility
First Priority Disposal is licensed and insured in the Commonwealth of Virginia. We take our work seriously and stand behind the quality of our service. However, our liability is limited as described in this section.
First Priority Disposal's total liability to the Customer for any claim arising from the rental or use of our services shall not exceed the total amount paid by the Customer for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
While we use driveway protection boards on every delivery, FPD is not responsible for damage to driveways, landscaping, underground utilities, or other property resulting from: (a) pre-existing structural weaknesses in the surface; (b) Customer-directed placement; (c) underground utility lines not marked by Virginia 811 prior to delivery; or (d) overloaded containers.
We strongly encourage all customers to call 811 (Virginia "Call Before You Dig") before requesting container placement on or near unpaved or soft-ground areas.
The Customer agrees to indemnify, defend, and hold harmless First Priority Disposal, its owners, employees, and agents from and against any claims, losses, fines, penalties, or liabilities arising from: (a) prohibited items placed in the container; (b) failure to obtain required permits; (c) overloaded containers; (d) false or inaccurate information provided at booking; or (e) unauthorized third-party use of the container.
Fuel Surcharge PolicyOne Flat Fee, Every Rental
First Priority Disposal applies a flat fuel surcharge to every dumpster rental rather than quietly building fuel costs into our base rates.
- The fuel surcharge is a flat $35.00 per rental.
- It is disclosed at the time of booking and itemized on your invoice.
- It does not change with your container size or with daily diesel prices.
Military & First Responder DiscountHonoring Those Who Serve
First Priority Disposal is a veteran-owned business operating in the heart of Hampton Roads — home to the world's largest naval installation and thousands of active duty service members, veterans, and first responders. Supporting this community is a core value, not a marketing tactic.
- A 5% discount is applied to the base rental price for all residential dumpster rentals.
- Eligible customers include: active duty military, veterans, National Guard and Reserve members, law enforcement officers, firefighters, and emergency medical personnel.
- Valid government-issued ID or military ID is required at time of booking or delivery.
- The discount applies to the base rental price only and may not be combined with other promotional offers unless explicitly stated.
- The discount does not apply to commercial accounts, unless otherwise negotiated in a written commercial agreement.
To claim your discount, simply mention it when you call 757-250-7985. We won't make you jump through hoops.
Commercial AccountsVolume Pricing & Net-30 Terms
First Priority Disposal values long-term commercial partnerships. Contractors, property managers, and businesses with ongoing waste removal needs may qualify for our Contractor Loyalty Program:

| Multi-Site Discount | 8% off | 3 or more simultaneous active rentals |

Commercial accounts with Net-30 billing terms are governed by a separate Commercial Account Agreement, which supersedes these Terms of Service where the two conflict. Overdue commercial invoices are subject to a 1.5% monthly late fee. First Priority Disposal reserves the right to suspend service for accounts in arrears.
